Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using any mobile application (“App”) or website provided by Supavoice S.N.C. (“Supavoice”, “we”, “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18 (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms. You must be at least 16 years old to access certain features involving data collection (e.g., contributing voice data for training).

3. User Accounts

  • Security: You are responsible for maintaining the confidentiality of your login credentials.
  • Email Sign-In: For eligible accounts, you may sign in with your email address via a one-time link or code. We do not store a password for these accounts; access depends on control of your email address, which you are responsible for keeping secure.
  • Responsibility: You are fully responsible for all activities that occur under your account.
  • Guest Accounts: We may offer guest access. If you uninstall the App without linking an account (e.g., Apple, Google), you may permanently lose your progress and data.

4. Content and Licensing

A. Supavoice Content

All music, lyrics, backing tracks, compositions, visual interfaces, code, and software in the App are the exclusive property of Supavoice or its licensors (“Supavoice Content”). They are protected by copyright and intellectual property laws.

B. Your Vocal Performance

You retain all ownership rights to the sound of your voice recorded through the App (“User Voice”).

C. Replays (Video Export)

The App allows you to generate videos combining your User Voice with Supavoice Content (“Replays”).

  • License to You: Supavoice grants you a perpetual, non-exclusive, worldwide license to share these specific Replay files on social media platforms (e.g., TikTok, Instagram) for personal, non-commercial use only.
  • Restrictions: You may not extract the backing tracks, reverse engineer the audio, or use the Supavoice Content separately from the Replay video.

D. Optional Data Contribution (AI Training)

If you explicitly opt-in to contribute your voice data for research:

  • You grant Supavoice a non-exclusive, worldwide, royalty-free license to use, analyze, and process your anonymized audio recordings for the purpose of training and improving artificial intelligence and audio processing models.
  • You understand this contribution is voluntary and can be stopped at any time via App settings.

5. Subscriptions and Purchases

  • Billing: Purchases made via App Store or Google Play are subject to the respective store’s payment terms. Purchases made on our website are processed by Stripe.
  • Consumable Access Passes: Some products are consumable access passes (e.g., “Pass 24h”). These are not subscriptions and do not auto-renew. A pass is consumed when you start the access it grants, and passes do not expire until used unless stated otherwise.
  • Renewals: Where offered, subscriptions automatically renew unless canceled at least 24 hours before the end of the period.
  • Refunds:
    • In-App Purchases: Refunds are handled exclusively by Apple or Google according to their policies.
    • Website Purchases: For purchases made directly on our website, EU customers have a 14-day right of withdrawal for digital goods unless they have already started downloading or using the content. A consumable access pass is treated as used once activated.
    • Reversals: A refund or chargeback may revoke the corresponding unused access (for example, the unused pass balance granted by that purchase).
  • Price Changes: We reserve the right to adjust pricing. Any changes to recurring subscriptions will be communicated in advance.

5a. Gift Coupons

  • Redemption: A gift coupon grants the recipient one or more access passes when redeemed. You may send or redeem coupons you already hold.
  • No New Sales: We no longer sell new gift coupons; only coupons acquired previously remain valid.
  • Reversals: A refund or chargeback on the original purchase revokes any unredeemed passes from that coupon.

6. Prohibited Conduct

You agree not to:

  • Use the App for any illegal purpose.
  • Reverse engineer, decompile, or attempt to derive source code from the App.
  • Use automated systems (bots) to access the Services.
  • Upload content that is hate speech, harassment, or violates third-party rights.

7. Termination

We reserve the right to suspend or terminate your account without notice if you violate these Terms. Upon termination, your right to use the Services will immediately cease.

8. Disclaimers and Limitation of Liability

  • “As Is”: The Services are provided “as is” without warranties of any kind. We do not guarantee the App will be error-free or uninterrupted.
  • No Professional Advice: The singing feedback provided is for entertainment and educational purposes only and does not constitute professional vocal coaching.
  • Limitation: To the maximum extent permitted by law, Supavoice S.N.C. shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the last 12 months.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any dispute arising from these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the Court of Milan (Foro di Milano).

10. Changes to Terms

We may update these Terms. If changes are material, we will notify you within the App or via email. Continued use of the Services implies acceptance of the new Terms.

11. Third-Party Services

The Services may allow you to export content to third-party applications (e.g., TikTok, Instagram, YouTube). These platforms are not controlled by Supavoice. We are not responsible for their content, policies, or practices. Your use of such services is governed by their respective terms.

We also rely on third-party providers to operate the Services, including payment processors (Stripe, Apple, Google; see Section 5) and Amazon SES for sending email.
